LUMIHUGS Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, online store, products, services, content, features, tools, and related services operated by NOMAD CREATIVE CREW LLC, doing business as LUMIHUGS (“LUMIHUGS,” “we,” “us,” or “our”).

By accessing our website, using our Services, creating an account, placing an order, joining our waitlist, making a pre-order, reserving a Founder Batch product, or otherwise interacting with us, you agree to be bound by these Terms.

Please read these Terms carefully before using our Services.

1. Our Services

LUMIHUGS provides an online store for children’s bedtime comfort products, plush products, sleep-support accessories, and related products and content.

Our products may include plush items with integrated features such as soft lighting, calming sounds, remote control functionality, rechargeable components, weighted elements, and other comfort-focused design features.

The Services are intended for use by adults, parents, guardians, and authorized purchasers. Although some products are designed for children, our website and checkout are not intended for use by children.

2. Eligibility

By using our Services, you confirm that you are at least the age of majority in your jurisdiction or that you are using the Services under the supervision of a parent or legal guardian.

If you purchase a product for a child, you are responsible for ensuring that the product is appropriate for the child’s age, needs, and circumstances, and that the product is used according to the instructions, warnings, labels, and care guidelines provided.

3. Product Information

We aim to provide accurate product descriptions, images, prices, availability, specifications, warnings, and other information.

However, we do not guarantee that all product descriptions, images, colors, dimensions, weights, availability, or other content are always complete, accurate, current, or error-free.

Product colors and appearance may vary depending on your screen, device, lighting, photography, production batch, or manufacturing tolerances.

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed.

4. Product Use and Safety

LUMIHUGS products must be used only as intended and in accordance with all instructions, warnings, labels, age recommendations, care instructions, and safety information provided with the product or displayed on our website.

Products with integrated electronic components, lights, sounds, batteries, charging cables, or remote controls must be handled with care and used under appropriate adult supervision.

Unless expressly stated otherwise, LUMIHUGS plush products with integrated electronic components should not be machine washed, submerged in water, exposed to excessive moisture, modified, opened, repaired by unauthorized parties, or used in a manner inconsistent with the product instructions.

We are not responsible for damage, injury, malfunction, or loss caused by misuse, improper handling, unauthorized modification, improper cleaning, failure to follow instructions, normal wear and tear, accidents, or use outside the product’s intended purpose.

5. No Medical or Therapeutic Advice

LUMIHUGS products are designed to support a calming bedtime routine and provide comfort.

They are not medical devices, therapeutic devices, healthcare products, or substitutes for professional medical advice, diagnosis, treatment, or therapy.

We do not guarantee that any product will diagnose, treat, cure, prevent, or improve any medical, psychological, behavioral, sleep-related, sensory, developmental, or health condition.

If you have concerns about a child’s sleep, anxiety, sensory needs, development, health, or safety, please consult a qualified healthcare professional.

6. Orders

When you place an order, you agree to provide accurate, current, and complete information, including billing, shipping, contact, and payment information.

We reserve the right to refuse, cancel, limit, or modify any order for any reason, including suspected fraud, pricing errors, product availability issues, incorrect information, violation of these Terms, or other business or legal reasons.

An order confirmation email does not guarantee acceptance of an order. Your order is accepted when we process and prepare it for fulfillment, unless otherwise stated.

7. Pricing and Payment

Prices are listed in the currency displayed at checkout and are subject to change without notice.

We reserve the right to modify prices, discounts, promotions, product availability, and offers at any time.

Payment is processed securely through Shopify and third-party payment providers. We do not directly store full payment card numbers.

You are responsible for any applicable taxes, duties, customs fees, import fees, shipping charges, or other charges associated with your purchase, unless otherwise stated at checkout.

8. Pre-Orders and Founder Batch Reservations

Some LUMIHUGS products may be offered as pre-orders, reservations, or part of a limited Founder Batch before they are available for immediate shipment.

If a product is offered as a pre-order, the product page, checkout, or related communication will provide an estimated shipping window or estimated availability date.

By placing a pre-order or Founder Batch reservation, you acknowledge that the product will not ship immediately and that estimated shipping dates may change due to production, quality control, logistics, customs, fulfillment, or other circumstances.

If the estimated shipping date changes materially, we will notify you using the email address provided at checkout and provide an updated estimated shipping window where available.

You may cancel a pre-order and request a refund before the order has been fulfilled, unless specific terms disclosed at checkout state otherwise and are permitted by applicable law.

Once a pre-order has shipped, our Return & Refund Policy applies.

9. Deposits and Partial Payments

We may offer certain products through deposit-based reservations or partial payment options.

If a deposit is offered, the applicable deposit amount, whether it is refundable or non-refundable, how it applies to the final purchase price, and any remaining payment obligations will be disclosed before checkout.

Unless otherwise stated, deposits are applied toward the final purchase price.

If a deposit is refundable, you may request cancellation and refund before final payment is collected or before the order is fulfilled.

If any deposit is non-refundable, this will be clearly disclosed before purchase, subject to applicable law.

10. Shipping and Delivery

Shipping costs, estimated delivery times, shipping methods, and available destinations are described in our Shipping Policy or at checkout.

Delivery dates are estimates only and are not guaranteed unless expressly stated.

We are not responsible for delays caused by carriers, customs, weather, incorrect shipping information, failed delivery attempts, third-party logistics providers, force majeure events, or circumstances beyond our reasonable control.

Risk of loss and title for products may pass to you upon delivery to the shipping carrier or delivery to the address provided, depending on applicable law and the shipping method used.

11. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, cancellations, defective products, and related issues are governed by our Return & Refund Policy.

Please review that policy before placing an order.

If there is a conflict between these Terms and our Return & Refund Policy regarding returns or refunds, the Return & Refund Policy will control for those specific matters.

12. Promotions, Discounts, and Gift Offers

We may offer promotions, discounts, bundles, founder gifts, free gifts, early access benefits, or limited-time offers.

Promotions are subject to availability and may be modified, suspended, or discontinued at any time.

Promotional gifts, free items, founder gifts, or bonus items may not be eligible for exchange, cash value, or separate refund unless required by law or expressly stated.

We reserve the right to cancel or refuse any promotion if we suspect abuse, fraud, error, or violation of the promotion terms.

13. Accounts

You may have the option to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate and complete information and to update it as needed.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or pose a security, legal, or operational risk.

14. Email, Marketing, and Communications

By placing an order, joining a waitlist, making a pre-order, contacting us, or creating an account, you agree that we may send you transactional communications related to your order, account, pre-order, shipping status, customer support requests, or other service-related matters.

If you subscribe to marketing emails, join the Founder List, or otherwise provide consent where required, we may send you promotional emails about LUMIHUGS products, launch updates, offers, surveys, and related content.

You may unsubscribe from promotional emails at any time using the unsubscribe link included in our emails.

15. User Content, Reviews, and Feedback

You may have the opportunity to submit reviews, comments, photos, videos, testimonials, survey responses, feedback, ideas, or other content (“User Content”).

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from such content for business, marketing, promotional, product development, and customer experience purposes, subject to applicable law.

You represent that your User Content does not violate any third-party rights, laws, privacy rights, intellectual property rights, or these Terms.

We reserve the right to remove or refuse User Content at our discretion.

16. Intellectual Property

All content on our website and Services, including text, images, graphics, logos, icons, product names, product designs, videos, audio, page layouts, trademarks, trade dress, designs, and other materials, is owned by or licensed to NOMAD CREATIVE CREW LLC, LUMIHUGS, or our licensors.

You may not copy, reproduce, distribute, modify, display, sell, resell, exploit, reverse engineer, or create derivative works from our content, products, designs, branding, or Services without our prior written permission.

The names “LUMIHUGS,” related logos, product names, visual identity, and brand elements are trademarks, trade names, or brand assets of NOMAD CREATIVE CREW LLC or its affiliates.

17. Prohibited Uses

You agree not to use the Services to:

• violate any applicable law or regulation;
• infringe our intellectual property rights or the rights of others;
• submit false, misleading, fraudulent, or inaccurate information;
• interfere with the security, functionality, or operation of the Services;
• attempt unauthorized access to our systems, accounts, data, or networks;
• upload or transmit viruses, malware, harmful code, or disruptive technologies;
• scrape, copy, harvest, or collect data from the Services without permission;

To the fullest extent permitted by applicable law, NOMAD CREATIVE CREW LLC, LUMIHUGS, and their owners, officers, employees, contractors, affiliates, service providers, and partners will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, or other intangible losses arising from or related to your use of the Services or products.

To the fullest extent permitted by law, our total liability for any claim related to the Services or products will not exceed the amount you paid for the product or service giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

23. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless NOMAD CREATIVE CREW LLC, LUMIHUGS, and their owners, officers, employees, contractors, affiliates, service providers, and partners from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

• your use of the Services;
• your violation of these Terms;
• your misuse of our products;
• your violation of any law or third-party rights;
• your User Content;
• fraudulent, abusive, or unauthorized activity connected to your account or order.

24. Governing Law

These Terms and any dispute arising from or related to these Terms, the Services, or your purchase are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles, except where prohibited by applicable consumer protection laws.

25. Dispute Resolution

Before initiating a formal legal claim, you agree to contact us first at support@lumihugs.com so we can attempt to resolve the issue informally.

If a dispute cannot be resolved informally, it will be handled in accordance with applicable law and the governing law stated above.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

26. Termination

We reserve the right to suspend or terminate your access to the Services, cancel orders, refuse service, or close accounts if we believe you have violated these Terms, engaged in fraudulent activity, created legal or operational risk, or misused the Services.

27. Changes to These Terms

We may update or modify these Terms from time to time.

The updated version will be posted on our website with a revised effective date. Your continued use of the Services after changes are posted means you accept the updated Terms.
